1. Driver Requirements

1. Minimum Age

  • The minimum age to rent a standard luxury vehicle is 25 years.
  • For special luxury models (e.g., supercars, limited-edition vehicles), the minimum age is 30 years.
  • This reflects common practice among premium-car providers in Spain, where younger drivers face higher premiums due to risk factors.

2. Licence Validity

  • All drivers (primary and additional) must present a full, valid driving licence in their own name, which has been held for at least five years.
  • A licence held for less than two years may incur a surcharge or result in refusal of rental, in line with industry norms.

3. Additional Drivers

  • You may add an extra driver on site at no charge; pre-booking is not required.
  • The additional driver must comply with all requirements listed herein (age, licence validity, ID).

4. Identification Documents

  • The primary driver and any additional drivers must present upon vehicle pick-up:
    • A valid photo driving licence (EU/EEA licences or an equivalent foreign licence).
    • A valid International Driving Permit (IDP) if the driving licence is not in the Roman alphabet or does not include a photograph (e.g., older paper licences, some non-EU licences).
    • A valid passport or, if you are an EU/EEA national, a valid national ID card.
  • Photocopies are not accepted; originals must be presented at pick-up.

5. Deposit

  • A security deposit will be blocked on a credit card in the primary driver’s name at the start of the rental.
  • Deposit amounts by vehicle category are as follows:
    • American Basic Cars (e.g., Ford Mustang, Chevrolet Camaro classic models): €1 000.
    • American Premium Cars (e.g., high-trim American models with custom features): €1 500.
    • Premium European Cars (e.g., Mercedes-Benz AMG, BMW M-Series): between €2 500 and €3 000.
    • Supercars (e.g., Ferrari, Lamborghini, high-end McLaren): between €5 000 and €7 000.
  • These amounts align with typical deposit ranges in Spain for prestige and exotic vehicles.
  • The deposit serves as security against damage, traffic fines, missing fuel, late returns, or other charges. It is released (unblocked) following vehicle return, subject to any deductions.

2. Fuel Policy

1. Fuel Type

  • All vehicles are supplied with petrol (octane 95 or octane 98), depending on the specific model.

2. Return Fuel Level

  • Vehicles must be returned with the same fuel level as on pick-up.
  • If the fuel level is lower, you will be charged at the prevailing refill rate plus a service fee, calculated per litre shortfall.
  • No refund is given for unused fuel.

3. Reservations and Payments

1. Reservation Confirmation

      1. Reservation requests are confirmed once we receive your request via WhatsApp or Telegram at the client’s mobile number.
      2. You will receive a confirmation message detailing the agreed pick-up/drop-off dates, times, vehicle model, and total rental cost.

2. Payment Methods

      1. A valid credit card in the primary driver’s name is required to secure the booking and cover the security deposit.
      2. We accept Visa, Mastercard.
      3. Cash payments are accepted for both the rental payment and the security deposit, provided they do not exceed €1 000 in a single transaction, in accordance with Spanish legal-tender requirements.
      4. Debit cards, cheques, and traveller’s cheques are not accepted for the security deposit or rental payment.

4. Charges Not Included in the Rental Price

1. Traffic Fines and Infractions

  • Renters are fully responsible for all traffic fines (speeding, parking, tolls, etc.) incurred during the rental period, including any administrative fees or penalties.
  • We reserve the right to charge an administration fee of €25 for processing any fines/infractions associated with the vehicle.

2. Lost or Damaged Keys

  • Loss or damage to any car key or remote control will be charged at full replacement cost (typically €300–€500, depending on the model).

3. Excessive Cleaning Fees

  • Standard cleaning is included. However, if a vehicle is returned heavily soiled (e.g., pet hair, stains, excessive dirt), an extra deep-cleaning fee will apply, determined by the level of soiling.
  • If child seats or other accessories require special cleaning, those costs will also be charged to return the vehicle to its original condition.

5. Price Policy, Extra Hours & Kilometre Limitations

1. Agreed Rental Period

  • The rental price is based on the pick-up and drop-off dates and times agreed at booking.
  • No refunds will be made for any unused portion of the originally agreed rental period.

2. Peak Season Rates

  • Daily rates may fluctuate during peak periods (e.g., summer months, major events).
  • We will inform you of any rate changes before confirming your reservation.

3. Extra Hours Penalty by Vehicle Category

  • For American Basic Cars, the late-return penalty is €18 per hour.
  • For American Premium Cars, the late-return penalty is €28 per hour.
  • For Premium European Cars, the late-return penalty is €32 per hour.
  • For Supercars, the late-return penalty is €48 per hour.
  • If you anticipate being late, you must contact our 24/7 support immediately; otherwise, we may recover the vehicle at your expense and treat it as an early return with no refund.

4. Extra Kilometres (Limited-Mileage Vehicles Only)

  • Certain vehicles are offered with a limited-kilometre allowance per rental. If you exceed the included kilometres, the following charges will apply for each
    additional kilometre driven:
    • American Basic Cars: €0.80 per extra kilometre.
    • American Premium Cars: €1.50 per extra kilometre.
    • Premium European Cars: €3.00 per extra kilometre.
    • Supercars: €5.00 per extra kilometre.
  • These rates reflect the higher maintenance and wear-and-tear costs associated with high-performance vehicles.

5. Child Seats and Booster Seats

  • Child or booster seats are available at no extra charge, subject to availability.

6. 24/7 Support

  • We provide 24-hour emergency assistance to all customers.
  • The 24/7 emergency contact number is listed in your rental agreement.
  • Assistance includes breakdown cover, flat tyre service, battery jump-start, and roadside assistance.

7. Important Use Restrictions

1. Permitted Use

  • Vehicles must be driven only by authorised drivers listed in the rental agreement.
  • They must be used solely for personal, non-commercial purposes.
  • Smoking and the transport of animals inside the cabin are strictly prohibited; a minimum cleaning fee of €200 will apply for any breach.

2. Prohibited Activities

  • Racing, drifting, burnouts, or any use that could cause excessive wear or damage is strictly forbidden.
  • Overloading the vehicle (exceeding the permitted number of passengers or luggage) is prohibited.
  • Towing other vehicles or using the car in any motorsport activity is not allowed.
  • Driving under the influence of alcohol or illegal drugs is forbidden; Spanish law sets a maximum blood-alcohol limit of 0.05 % (0.03 % for novice drivers).

3. Stickers and Adhesives (Weddings/Celebrations)

  • The installation of any stickers, decals, or adhesives for weddings, celebrations, or promotional events is strictly prohibited.
  • In the event that any such material is applied, and if it causes damage to the paintwork or any other part of the vehicle, the renter will be required to pay for all necessary repairs to restore the vehicle to its original condition.

4. Misuse Leading to Automatic Deposit Forfeiture

  • If the company detects any misuse of the vehicle as described in the sections above (e.g., prohibited activities, installation of prohibited accessories, reckless driving), it shall constitute grounds for forfeiture of the entire security deposit blocked at the start of the rental.

5. Vehicle Inspection

  • Upon return, one of our representatives will inspect the vehicle in your presence.
  • Any new damage or missing items identified at that time will be reported, and you will be charged for repair or replacement.

8. Cancellation and Admission Policy

1. Right to Refuse or Cancel

  • CanaryIslandsLuxuryCars.com reserves the right to refuse or cancel any reservation if any driver is deemed “unfit” (e.g., history of serious traffic infractions, insufficient licence tenure, or failure to meet age/licence requirements).
  • We also reserve the right to refuse or cancel if we ascertain that the customer is not responsible or is likely to misuse our vehicles (e.g., intending prohibited activities).
  • In such cases, any pre-paid amounts will be refunded in full within 30 days.

2. Responsible Driving

  • We seek clients who will treat our vehicles with the utmost care and respect.
  • Behaviour that endangers public safety or the vehicle (e.g., reckless driving, street racing) may result in immediate termination of the rental, vehicle recovery at your expense, and forfeiture of any prepaid amounts.

9. Insurance Policy

1. Third-Party Liability Only

  • All rentals include only the statutory Third-Party Liability Insurance (Responsabilidad Civil) as required by Spanish law.
  • This covers damages to other people, vehicles, or property if you are at fault in an accident.

2. Client’s Liability for Own Damage

  • Any damage to the rented vehicle itself (collision, theft, vandalism) is your responsibility unless otherwise stated in optional cover supplements (none are offered).
  • You are liable for the full repair cost or market value in case of total loss.

3. Optional Supplements

  • No additional waivers (Collision Damage Waiver, Theft Protection) are offered.
  • We strongly recommend that you verify whether your credit card or travel insurance provides coverage for collision/excess reimbursement before
    arrival.

10. Refund Policy

  • Once the vehicle has been picked up, no refunds will be issued for any remaining rental days. This policy is strictly enforced and non-negotiable.

11. Additional Charges

1. Late Return Fee

  • Vehicles returned after the agreed return time without prior consent will incur a category-specific late-return penalty (see Section 5.3).
  • If you anticipate being late, you must contact our 24/7 support immediately; otherwise, we may recover the vehicle at your expense and treat it as an early return with no refund.

2. One-Way Fee

  • If you return the vehicle to a different location than originally agreed, a one-way fee will apply, based on the distance between locations. This fee is detailed in the Rental Agreement Summary.

3. Administration Fee for Fines/Incidents

  • A non-recoverable administration fee of €25 is charged to process any traffic fines, tolls, or parking tickets incurred during the rental.

4. Refuelling Service Fee

  • If the vehicle is returned with less fuel than at pick-up, a refuelling fee applies, covering the cost of missing fuel (per litre rate) plus a service charge.

12. Governing Law and Dispute Resolution

1. Governing Law

  • This Rental Agreement is governed by the laws of Spain. Any dispute arising from or related to this agreement shall be subject to the jurisdiction of the Spanish courts.

2. Alternative Dispute Resolution

  • In accordance with EU consumer rights, you may use the European ODR platform (http://ec.europa.eu/consumers/odr/) to resolve disputes.
